Steadfast ID User Agreement
This User Agreement (“Agreement”) governs the use of Steadfast ID by individual users (“User”) who are authorised by an Organisation to access digital platforms operated by Steadfast under that Organisation’s credentials.
By clicking “Accept” or otherwise using Steadfast ID, you agree to be bound by the terms of this Agreement with Steadfast Technologies as a User.
- Defined Terms
- In this Agreement:
- Organisation means an entity that has in place an agreement with Steadfast to access at least one of the digital platforms offered by Steadfast which are accessible through Steadfast ID.
- Steadfast Technologies means Steadfast Technologies Pty Ltd ACN 137 125 734.
- Steadfast means Steadfast Group Limited ACN 073 659 677 or one or more of its subsidiaries.
- Steadfast ID means the identity management system administered by Steadfast Technologies that enables Users to authenticate and interact with digital platforms operated by Steadfast using credentials issued to the Organisation and created by that Organisation for the User.
- Privacy Policy means the privacy policy of Steadfast for the relevant jurisdiction, as amended from time to time and available at Privacy Policy - Steadfast.
- In this Agreement:
- User Conduct and Acceptable Use
- The User must:
- use Steadfast ID solely for legitimate business purposes authorised by the relevant Organisation;
- not use Steadfast ID to access services, systems or data for which they are either not expressly authorised or if they are no longer employed by an Organisation;
- not share, disclose, grant or otherwise permit any other person to use Steadfast ID, including without limitation persons who are not part of the Organisation;
- not engage in any activity that may compromise the security, integrity or availability of Steadfast ID, including but not limited to unauthorised access, credential misuse, or circumvention of authentication protocols;
- comply with all applicable laws and any acceptable use or similar policies reasonably required and notified by Steadfast Technologies; and
- only use Steadfast ID when primarily within Australia.
- The User must:
- Suspension and Termination
- Steadfast Technologies may either suspend or revoke the User’s access to Steadfast ID at any time if it reasonably determines that the User has:
- breached this Agreement;
- engaged in conduct that poses a risk to the security or integrity of Steadfast ID; or
- ceased to be authorised by the relevant Organisation.
- Suspension or termination under this clause does not affect any other rights or remedies available to Steadfast Technologies.
- Steadfast Technologies may either suspend or revoke the User’s access to Steadfast ID at any time if it reasonably determines that the User has:
- Privacy and Data Handling
- Personal information collected in connection with the User’s use of Steadfast ID will be handled in accordance with the Privacy Policy and the Privacy Act 1988 (Cth).
- The User consents to the collection, use and disclosure of their personal information for the purposes of system administration and access management.
- The User acknowledges that their personal information may be shared with Organisations and service providers to facilitate the operation of Steadfast ID, subject to the Privacy Policy.
- Australian Consumer Law
- Except as set out in this Agreement, all implied conditions, warranties, guarantees and rights are excluded from this Agreement. Where legislation (including the Competition and Consumer Act 2010 (Cth)) implies conditions, warranties or guarantees or give other rights in respect of this Agreement, the Steadfast Technologies liability for any breach of such a condition, warranty or right will (but only to the extent permitted by law) be limited:
- in the case of goods supplied, to the replacement or repair of the goods or the supply of equivalent goods, the payment of the cost of repairing or replacing the goods or of acquiring equivalent goods;
- in the case of services supplied, to the supplying of the services again or the payment of the reasonable cost of having the services supplied again.
- Except as set out in this Agreement, all implied conditions, warranties, guarantees and rights are excluded from this Agreement. Where legislation (including the Competition and Consumer Act 2010 (Cth)) implies conditions, warranties or guarantees or give other rights in respect of this Agreement, the Steadfast Technologies liability for any breach of such a condition, warranty or right will (but only to the extent permitted by law) be limited:
- Governing Law
- This Agreement is governed by the laws of New South Wales, Australia.
- The parties irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
